Terms and Conditions

These terms and conditions apply to all bookings made through Vesterålen Activities ("we", "us", "our"), operated by Vesterålen Drift AS, org. no. 933 231 925, Sortland, Norway. By making a booking, you ("the customer") agree to the following terms.

1. Booking and payment

All prices are listed in Norwegian Kroner (NOK) and include 25% VAT unless otherwise stated. Full payment is required at the time of booking when paying by card. Tour operators may request payment by invoice, in which case the booking is confirmed immediately and the invoice is due within 14 days.

A booking is confirmed when full payment has been received, or when an invoice booking has been accepted by us. You will receive a confirmation email with your booking number and details.

2. Cancellation by the customer

The following cancellation policy applies unless otherwise specified for a particular activity:

Boat rental:

• More than 7 days before the rental start date: full refund.
• 3 to 7 days before the rental start date: 50% refund.
• Less than 3 days before the rental start date: no refund.

Activities and equipment hire:

• More than 48 hours before the activity start time: full refund.
• Less than 48 hours before the activity start time: no refund.

To request a cancellation, please use the cancellation link provided in your booking confirmation email, or contact us at contact@vesteralenapartment.com. Refunds are processed manually and may take 5–10 business days to appear on your statement.

3. Cancellation or changes by the operator

We reserve the right to cancel or reschedule any activity or boat rental due to adverse weather conditions, safety concerns, equipment failure, or other circumstances beyond our control. In such cases, you will be offered a full refund or the option to reschedule to an alternative date, subject to availability.

We are not liable for any additional costs incurred by the customer as a result of cancellation or rescheduling, including but not limited to travel, accommodation, or other bookings.

4. Participation and safety

Participation in outdoor activities and use of rental equipment involves inherent risk. Customers are required to follow all instructions given by our staff and guides. The customer is responsible for:

• Ensuring that all participants are physically fit and able to participate in the booked activity.
• Following all safety instructions provided by our staff and guides.
• Wearing appropriate clothing and footwear for the activity and weather conditions.
• Holding valid travel and personal insurance covering outdoor activities in Norway.

We reserve the right to refuse participation to any person who, in the judgment of our staff, poses a safety risk to themselves or others, including due to intoxication or failure to follow safety instructions. No refund will be given in such cases.

5. Boat rental — specific terms

When renting a boat from us, you agree to the following:

Operator qualifications: Under Norwegian law, persons born on or after 1 January 1980 must hold a valid Norwegian boating licence (båtførerbevis) or equivalent international qualification to operate a boat with an engine exceeding 25 horsepower or a length exceeding 8 metres. Persons born before 1980 are exempt from this requirement. Foreign boating licences issued in an EEA country or in English are accepted. It is the renter's sole responsibility to ensure they meet these requirements. We may ask to see proof of qualification before handover.

Alcohol and substances: It is strictly prohibited to operate the boat under the influence of alcohol, drugs, or any other substances that may impair judgment, reaction time, or the ability to safely operate the vessel. This is in accordance with Norwegian law (Småbåtloven). Violation will result in immediate termination of the rental with no refund. We reserve the right to refuse handover of the boat if we suspect the renter is under the influence.

Security deposit: A security deposit or card pre-authorisation may be required before handover of the boat. We reserve the right to charge the renter for documented damage, missing equipment, abnormal cleaning, refuelling, or late return.

Fuel policy: The boat is delivered with a full tank of fuel and must be returned with a full tank. Fuel costs during the rental period are the responsibility of the renter. If the boat is returned without a full tank, we will refill it on the renter's behalf and charge the fuel used plus a service fee.

Operating area and restrictions: The boat may only be operated within the area approved by us at handover. The renter may not sublet, lend, or otherwise hand over the boat to any third party without our written consent. We reserve the right to restrict use based on weather, wind, sea state, or the experience of the renter.

Safe operation: The boat must be operated in a safe and responsible manner at all times, in accordance with Norwegian maritime regulations (Småbåtloven). The renter is responsible for the safety of all passengers on board.

Life jackets: Life jackets must be worn by all passengers at all times while on the water. Life jackets are provided with the boat.

Reporting of incidents: Any grounding, collision, engine alarm, technical fault, or damage must be reported to us immediately — not only upon return. Failure to report incidents promptly may result in additional liability for the renter.

Damage and liability: The renter is responsible for any damage to the boat, motor, or equipment caused during the rental period, beyond normal wear and tear. Any damage must be reported to us immediately.

Return: The boat must be returned by the agreed date, in the same condition as it was received. Late return may incur additional charges at the daily rental rate.

6. Equipment rental

Rental equipment (fishing rods, floating overalls, batteries for electric reels, etc.) must be returned in the same condition as received. The customer is liable for any lost, stolen, or damaged equipment and will be charged the replacement cost.

7. Sauna — specific terms

The sauna is booked in 2-hour slots for your whole group. The following terms apply to all sauna bookings:

Towels: Guests must bring their own towels. For hygiene, please sit on a towel on the benches at all times.

Use of the stove: Saltwater must never be poured on the stove under any circumstances — doing so will damage the heater. Fresh water is provided inside the sauna for use on the stove; use it sparingly. Do not touch the stove itself, as it becomes extremely hot and causes burns.

Health and safety: Sauna bathing is not recommended for pregnant women or people with heart conditions, high or low blood pressure, or similar health concerns. Do not use the sauna while under the influence of alcohol or other substances. If you feel unwell, leave the sauna immediately.

Alcohol and smoking: The use of alcohol in the sauna is strictly prohibited. Smoking is prohibited at all times due to fire risk. Glass bottles and glassware must not be brought into the sauna or onto the dock.

Children: Children must be accompanied by a responsible adult at all times and must be kept away from the stove.

Maximum occupancy: The sauna may be used by no more than 8 persons at any time.

Swimming: Swimming and bathing are entirely at your own risk. Only the floating dock is suitable for swimming, where a bathing ladder is provided. Under no circumstances should anyone jump into the sea from the pier. Be aware of boats arriving at and departing from the dock. We accept no liability whatsoever for any injury, accident, or drowning arising from swimming or bathing.

End of slot and condition: Please vacate the sauna on time so it is ready for the next guests. Leave the sauna clean and tidy. The customer is responsible for any damage to the sauna or its equipment caused during their booking.

Pre-heating: Pre-heating is an optional paid add-on and is only available for slots starting at or before 18:00.

Cancellation: The activities cancellation policy in section 2 applies — more than 48 hours before the start time: full refund; less than 48 hours before the start time: no refund.

8. Liability

Vesterålen Activities acts as a provider of outdoor experiences and boat rental services. We are not liable for:

• Personal injury, illness, or death arising from participation in activities or use of equipment, except where caused by our negligence.
• Loss or damage to personal property during activities or boat rental.
• Delays or cancellations caused by weather, natural events, or other force majeure.
• Any indirect or consequential losses.

Our total liability for any claim shall not exceed the amount paid by the customer for the relevant booking.

9. Personal data and privacy

We collect and process personal data (name, email, phone number, and booking details) solely for the purpose of managing your booking, sending confirmation and follow-up communications, and complying with legal obligations.

Your data is stored securely in our booking system and is not shared with third parties except as necessary to process payments (Stripe) or send communications (Resend). Payment card details are handled entirely by Stripe and are never stored on our servers.

You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us at contact@vesteralenapartment.com.

We comply with the Norwegian Personal Data Act and the EU General Data Protection Regulation (GDPR).

10. Partner and tour operator bookings

Tour operators and partners booking on behalf of their guests agree to communicate these terms and conditions to their guests prior to participation. The tour operator or partner is responsible for ensuring that all participants are informed of the relevant safety requirements and cancellation policies. The partner is also responsible for providing accurate information about participants, including relevant experience levels and any health conditions that may affect safe participation.

11. Intellectual property

All content on our website, including text, images, logos, and design, is the property of Vesterålen Activities and may not be reproduced without written permission.

12. Governing law

These terms and conditions are governed by Norwegian law. Any disputes arising from or in connection with a booking shall be resolved in accordance with Norwegian law.
